Welcome to Concrix Malaysia ("the Platform"), a marketplace operated by Concrix Malaysia Sdn Bhd (202601004235 (1666332-A)) ("we", "us" or "our"). The Platform connects sellers who have excess, used or repurposed construction materials with buyers who wish to purchase them.
By accessing or using the Platform, you agree to be bound by these Terms & Conditions, our Privacy Policy and our Return & Refund Policy. If you do not agree, you must stop using the Platform.
1. Our role as a venue
The Platform is a venue for buyers and sellers to find each other and agree a sale. The contract of sale is between the buyer and the seller — we are not a party to it. Consequently, we are not responsible for the quality, safety, legality or accuracy of any listing, the ability of a seller to sell or a buyer to pay, or any content posted by users. Your use of the Platform and your dealings with other users are at your own risk.
2. User accounts
You must register an account to use the Platform. You're responsible for keeping your account information accurate and your password secure, and for all activity under your account. You may not operate multiple accounts or transfer your account to another party without our permission.
3. Listings and transactions
For every listing, sellers must provide an accurate description, condition (new, used or repurposed), high-resolution photos, quantity and estimated price. All listed materials must be construction-related and suitable for reuse, and all listing content must be true and not misleading.
A "Verified Seller" badge indicates the seller has provided valid SSM registration and proof of stock ownership, and has agreed to our Zero-Misrepresentation Guarantee. Listings are an invitation to treat, not a binding offer — a transaction is formed once buyer and seller agree on price and terms through the Platform, and is conditional on the buyer's pre-loading inspection as set out in our Return & Refund Policy.
4. Fees and payment
We charge a service fee on each successful transaction, deducted from the buyer's payment. Fees are non-refundable except as set out in these Terms. Payments are processed by a third-party payment processor and held securely until the buyer completes the pre-loading inspection. If a transaction is not completed — for example the inspection fails and the buyer rejects the materials — funds are refunded to the buyer in accordance with our Return & Refund Policy. You're responsible for any taxes, including SST where applicable, arising from your use of the Platform.
5. Delivery and transport
Transport is an optional service we facilitate through a third-party logistics provider. We are not the transporter — any issues, including damage or delay in transit, are between you and the logistics provider under their own terms. The cost of transport is passed through to the buyer and is non-refundable.
6. Returns, refunds and disputes
All sales are final and non-refundable, subject to our Return & Refund Policy. If you have a dispute with another user, we encourage you to resolve it directly first. If notified, we will try in good faith to facilitate a resolution but are not obliged to do so; our decision, where we choose to intervene, is final.
7. Intellectual property
The Platform and its content — including text, graphics, logos and software — belong to Concrix Malaysia Sdn Bhd. You retain ownership of content you upload, but grant us a worldwide, royalty-free, sub-licensable licence to host, display, reproduce and distribute it for operating, promoting and improving the Platform. The "Concrix" name and logo are our trademarks and may not be used without our written permission.
8. Prohibited activities
You agree not to:
- Post content that infringes another party's rights, or that is unlawful, defamatory or obscene.
- List illegal, hazardous or stolen materials.
- Use the Platform to arrange a private sale outside the marketplace to avoid our fees.
- Upload viruses or other harmful code, or use bots, scrapers or crawlers against the Platform.
- Create fake or duplicate accounts, or abuse promotions or discount codes.
- Use the Platform in a way that risks non-compliance with anti-money-laundering or counter-terrorist-financing laws.
- Interfere with the operation of the Platform or other users' use of it.
9. Suspension and termination
We may suspend or terminate your account at our discretion, without prior notice, including for breach of these Terms. If we do so for a breach, fees already paid are not refunded, and you may lose access to content associated with your account.
10. No warranty and limitation of liability
The Platform is provided "as is" and "as available." We don't warrant that it will be secure, uninterrupted or error-free. Where something goes wrong with the Services, your remedy is to stop using the Platform and/or close your account; to the maximum extent permitted by law, we are not liable for losses arising from your use of the Platform or your dealings with other users.
11. Indemnity
You agree to indemnify Concrix Malaysia Sdn Bhd, its officers, employees and agents against claims, losses and expenses arising from your use of the Services, your content, your breach of these Terms, or your violation of another person's rights.
12. Governing law
These Terms are governed by the laws of Malaysia, and the courts of Malaysia have non-exclusive jurisdiction over any related dispute.
13. Changes to these Terms
We may update these Terms from time to time by posting the revised version on the Platform. Continued use after changes take effect means you accept the updated Terms.
